Part 2. AGREEMENT TO TERMS AND CONDITIONS – INDEMNITY FORM
In consideration of Variety permitting the Entrant to take part in the Bash, the Entrant will comply with the following Terms and Conditions:
- Definitions in this Agreement:
- ‘Bash’ means Variety NT Bash;
- ‘Bash Chair’ means that person nominated by Variety in charge of the Event;
- ‘Bash Rules’ means the rules set out in the document produced by Variety NT entitled ‘Bash Rules’;
- ‘Claim or Demand’ means any claim, demand, action, proceeding, judgement, order, award, damage or costs of any nature;
- ‘Crew’ two to four entrants in one vehicle – unless express permission of Bash Chair is gained;
- ‘Entrant’ is an individual person that has been accepted to participate in the Variety NT Bash and also includes the legal or personal representatives of the person;
- ‘Support Crew’ means and includes (but is not limited to) each person travelling with a crew but in a separate 4WD or Bash Car and each person assisting that crew in any way including (but not limited to) a mechanic, a member of a mobile workshop crew or supply crew or any person acting in that capacity and their legal or personal representatives;
- ‘Landowner’ means and includes the owner, lessee or occupier of any land and any employee, agent or independent contractor of any such person;
- ‘Team’ means any more than one crew;
- ‘Variety’ means and includes Variety, the children’s charity and each of its officers, members, employees, agents and independent contractors and any volunteer assisting it in connection with the Bash;
- ‘Vehicle’ means a conventional two wheel drive motor vehicle also known as a Bash Car.
2. Variety NT shall select those of the applicants who are to join the Bash. The criteria for selection will be as determined by Variety NT from time to time. Variety NT shall not be required to give any reason for the non-selection of an applicant and no correspondence will be entered into. Any applicant who is not selected not be refunded their application fee or any contributions.
3. All vehicles entered in the Bash must be more than 30 years old during the year of the Bash. They must be licensed, insured and roadworthy as prescribed by State / Territory laws. Some exemptions are allowed for elaborately themed vehicles (see applicant’s manual). Vehicles claiming an exemption, as an elaborately themed vehicle will require approval by Variety NT.3. All vehicles must be conventional two-wheel drive vehicles with a maximum crew of four people. Motorcycles, buses, coaches, caravans, skateboards, motorised wheelbarrows or support vehicles are generally not allowed but exceptions may be allowed with express approval from the Bash Chair.
4. In addition to the application fee of $550.00, applicants must obtain further contributions (including donations) of at least $5,000.00 which must all be paid in full two weeks prior to the start of the Bash or the applicant will not be permitted to Bash. Further conntributions may be made during and after the Bash but will NOT count towards awards or team tally.
5. Variety NT does not provide any taxation advice and makes no representations concerning the income tax deductibility or any entitlement to an input tax credit for any fees or contributions made to Variety NT. The applicant should seek and obtain their own independent legal advice concerning all such matters.
6. Performance modifications or high-performance models are not allowed. Variety NT reserves the right to class a model as a high-performance vehicle. A vehicle may be modified for strength or safety purposes (brakes, wheels, suspension, fuel tank, lights etc.) but not for speed (engine, gearbox, transmission etc.). No smoke emitting equipment is allowed.
7. The applicant’s number, that is determined and advised by Variety NT, must be fixed to the space on the door panel sticker. This sticker must be attached unaltered to the front doors of the vehicle. The Bash applicant’s number must also be visible on the top left-hand corner of the windscreen and the top righthand corner of the rear windscreen. All cars must display the event sponsors stickers, which will be
supplied by the organisers.
8. All applicants and anyone taking part in the Bash in any way must sign an indemnity form supplied by Variety NT.
9. All applicants must have paid the $550 application fee to Variety NT by 1 April 2022. If you had registered for the 2022 Bash this automatically registers you into the 2022 NT Bash and there is no requirement to register again.
10. At all times applicants must abide by the rules of the road as prescribed by State / Territory laws and statutes.
11. Applicants must observe all rules and regulations and vehicle specifications issued by Variety NT. All applicants must comply with the Bash Code of Conduct.
12. An applicant must not carry out any fundraising activity which may bring Variety NT’s name into disrepute or cause Variety NT to breach any statutory requirements.
13. Applicants are not to operate bank accounts for the purpose of fundraising using the name of Variety, Bash, Bash car or any combination
14. An applicant shall not use the name Variety, Variety NT or represent that it, or any fundraising event, has any connection with Variety, without the prior written consent of Variety NT.
15. An applicant indemnifies Variety NT against any penalty or liability Variety NT may incur as a consequence of any conduct of the applicant.
VARIETY NT DECISIONS AND RULINGS ARE FINAL AND BINDING ON ALL APPLICANTS AND APPLICATIONS
